Terms and conditions of sale ("Sales Terms")

These Sales Terms are applicable to the TrainingSite Webshop ("Online Shop") at www.trainingsite.no and to orders and sale transactions for goods and services ("Products") available at the Online Shop.
The Online Shop is owned by and operated by Seagull oil & gas AS (herein, "Seagull", "seller", "we" or "us" as the context may require). Seagull oil & gas AS is the seller of the Products.
The total contract basis for all sales at the Online Shop includes the terms and conditions given below, the Terms of Use, and the Licence Agreement for each Product, confirmed by an order confirmation.
The buyer is the person stated as the buyer on the order, and are hereinafter referred to as Customer.
Seagull follows the Norwegian electronic commerce law (ehandelsloven), Cancelaction Act (angrerettsloven) and the consumer law (forbrukerkjøpsloven), and otherwise other laws that regulate the business.
Rights of withdrawal
Registration for online courses is binding when confirming your order at TrainingSite.no. The Norwegian consumer law appies in its entirety when purchasing online courses at TrainingSite.no. Customer has 14 days right of withdrawal. The Customer will be immediately enrolled for the online courses upon order confirmation and payment.The right of withdrawal expires when the customer chooses to take the e-learning course in use, ie at the first login to the online course.
The message from the customer to Seagull on the use of right of withdrawal should be consideration of evidence in writing (return form, e-mail or letter) and it must contain information on how the customer will return the item to the seller. Seagull is obligated to credit the full purchase price to the Customer within 14 days from the date the seller receives the message or the goods are placed at the seller's disposal.
Delivery
Courses are considered delivered when the enrolment has been created, and the link to start a course appears on the Customers page at TrainingSite.no. Payment by VISA/MasterCard are therefore charged immediately.
Prices, Charges and VAT
The price charged for a Product will be the price in effect at the time the order is placed and will be set out in the order receipt and order confirmation emails. Seagull may change prices at any time without notice. Price increases will only apply to orders placed after such changes.
All prices include VAT. Total cost of the purchase will appear before ordering and include all expenses associated with the purchase, such as postage, shipping, packaging etc.
Abuse
The customer is granted a username and a password for personal login to the Products. The password is strictly personal and it is not permitted to share a user/password with others. Misuse may result in suspension from the course without compensation.
Information provided in the online store
We strive to provide our customers with accurate information about our products. We do, however, reserve the writing / printing errors may occur, which may mean that we can not deliver according to the information available in our webshop, marketing or otherwise.
Access, network problems
The customer is granted access to the course for a given time period from date of purchase. Seller is not liable for circumstances beyond its control, such as network problems etc.
Acceptance of Terms
By ticking the box "I have read and accept the Sales Terms..." in the Checkout page on our website, it is assumed that these conditions have been read and accepted by the Customer.
Processing of personal data
All personal information provided at registration is stored in Seagulls databases. Personal information will not be passed to any third parties. Upon registration the Custome allows Seagull to collect information about the Customers computer. The system automatically detects screen resolution, browser type, operating system, IP address etc. This information is stored securely together with personal information and will be used in statistics and in problem solving / technical support given to the customer. All activity in the course is also saved automatically. (Time logged in, number logins, results of assignments etc.). This is used for statistics and in order to make course ever better.
Liability
In no event shall TrainingSite and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use of the Products, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of Software, failure to provide services, or information available from the services.
Copyright
All content on this website is Seagulls or subcontractor of Seagulls property and is protected by copyright, marketing and trademark laws. This means that the trademarks, trade names, product names, information products, including without limitation mention of products images / graphics, design, layout and other content on this website in any case can not be downloaded, copied or used in any way without explicitly permitted under applicable law or the express written consent of Seagull.

By completing the user registration form (creating a user account) you agree to be bound by the following terms and conditions (“Terms of Use”).
Defenitions
“Customer” means the individual or the legal entity who activates Services provided by TrainingSite.no
“Software” means all visual, written or audible data, e-learning courses, information or material which are available in the Services.
“Services” means the web services, associated software, and other services related thereto provided to the User by TrainingSite in accordance with this agreement.
“Employer” means the legal entity entitled to ownership of the e-mail address used by the User upon registering and to which the User is associated through an employment relationship, consulting arrangement or similar circumstances. Employer shall not mean an Internet Service Provider (ISP) or similar provider.
“User” means the individual who registers a user account and gains access to the Services provided by TrainingSite.
“TrainingSite” means Seagull Oil & gas AS web site at http://www.trainingsite.no
Services and Rights of use
Subject to these Terms of Use, TrainingSite hereby grants to the User a non-transferable, non-exclusive, non-sublicensable limited term right to access and use the Services.
User Obligations
The User undertakes, in conjunction with registration, to provide correct information regarding the User’s identity and a correct and legitimate e-mail address.
The User shall be responsible for the activities conducted through use of the Services and shall ensure compliance with national laws in conjunction therewith.
The User undertakes to use the Services in such a manner that such use does not prevent or disrupt other computer communications or prevent or disrupt the equipment employed in order to provide and use the Services.
The User undertakes not to provide access to the Services to anyone else. User accounts cannot be shared or used by more than one individual User.
The user may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.
The User is obligated to notify TrainingSite regarding any suspected breach of these provisions.
Personal Data, Privacy
In order for the User to be able to use the Services, the User must provide certain data to TrainingSite, including but not limited to full name, e-mail address and contact details. Following receipt of such data, TrainingSite will process the same using automatic data processing in order to enable TrainingSite to administer and otherwise perform its obligations within the scope of the Services and to ensure that unauthorised persons do not gain access to the Services. TrainingSite will not disclose to any third party any personal information pertaining to the User. Upon request, the User has the right to access the personal data related to the User. The User also has the right and the obligation to rectify such data.
By accepting this agreement, the User explicitly consents to (a) the collection and processing by TrainingSite of personal data as described above, (b) the storage of such data until the user account is terminated by the User, and (c) the storage and retrieval of information on the User’s end terminal equipment as described above.
Security, Passwords, etc
The User shall ensure that identities, passwords, and equivalent obtained by the User in conjunction with registration are stored and used in a secure manner and cannot be accessed and thereby used by third parties. The User shall be liable for any unauthorized use of the Services.
Where it is suspected that any unauthorised person has become aware of the user identity and/or password, the User shall immediately inform TrainingSite thereof.
The User shall be liable for losses or damage incurred by TrainingSite where the User intentionally or negligently reveals the user identity/password to a third party. The User shall furthermore be liable for losses or damage incurred by TrainingSite where the user identity and password otherwise become known to an unauthorised party, unless the User notifies TrainingSite immediately upon suspicion that such has occurred.
TrainingSite shall adopt reasonable measures to ensure that the security of the Services meet relevant industry standards.
Confidentiality
TrainingSite undertakes not to disclose to any third party, or otherwise make available, information received by TrainingSite from the User within the scope of this agreement.
Amendments
TrainingSite reserves the right to amend the Terms of Use at any time without prior notice. The User shall be informed of such amendments by e-mail or through the information being made available on TrainingSite.
Access restriction and Premature Termination
TrainingSite shall be entitled, with immediate effect, to disable the User’s access to the Services or to prematurely terminate this agreement where: (a) the User uses the Services in a manner that entails the perpetration of a crime; (b) the User uses the Services in a manner that occasions losses or the risk of loss for TrainingSite or any third party; (c) the User uses the Services in a manner that violates TrainingSite’s security or administrative regulations; (d) the User uses the Services in a manner whereby the User utilizes resources or seeks unauthorised access to TrainingSite’s systems which are not intended for the User; or (e) the User otherwise fails to comply with the above and such breach of contract is material.
The User shall not be entitled to assign his/her rights or obligations under these Terms of Use.
Governing Law and Disputes
These Terms of Use and the ensuing relationship between TrainingSite and the User shall be construed in accordance with, and governed by, the laws of Norway
